Supreme Court rejects another illegal appeal

After an extraordinary and final judicial review before the Supreme Administrative Court, no flaws were found in the legally conducted EIA procedure of the investment proposal for "Construction of a new nuclear power plant of the latest generation at the Kozloduy NPP site, Site 2.".

By Decision No. 3922/13.03.2020 on adm. d. No. 12969/2019, the Five-member Panel – II Chamber of the Supreme Administrative Court rejected the application of an individual – well known to the “nuclear circles“, to annul Decision No. 4909/2019 of a five-member panel of the same court, which rejected all appeals against the Decision on Environmental Impact Assessment No. 1-1/2015 of the Minister of Environment and Water. Decision No. 3922/13.03.2020 is final and is not subject to appeal or annulment.

Thus, the EIA procedure for a new nuclear power plant at the Kozloduy NPP site went through the stages of regular and extraordinary judicial control, proving once again that all rules of international, European and national environmental legislation were observed during its implementation.
