State Decisions

  Pecision no259 since 8 April 2005 of the Council of Ministers, based on § 5 (62) from the additional provisions of the Spatial Planning Act, determines the energy installation ‘nuclear power plant of Belene site’ as a site of national importance. In decision no260 from the same date and year, the Council of Ministers on the basis of art. 45, para. 1 of the Safe use of nuclear energy  act approves the proposal of the Minister of Energy and Energy resources for the construction of a nuclear power plant at the Belene site and gives an agreement in principle for the construction of new nuclear capacity at the same site.

By decision No250 from 29 March 2012, the Council of Ministers terminates the abovementioned decisions no259 and no260. On 29 March 2012, the National Assembly of the Republic of Bulgaria decided to support the actions of the Council of Ministers to stop the construction of a nuclear power plant at the Belene site. With this decision the National Assembly instructs the Minister of Economy, energy and tourism to carry out the necessary actions for the construction of a new nuclear power plant at the site of Kozloduy NPP, using the equipment paid by the Republic of Bulgaria for the terminated project. Apart from this, on 11 April 2012, the Council of Ministers adopted a decision regarding article 45, para. 1 by Safe Use of Nuclear Energy Act, which gives an agreement in principle for the construction of new nuclear power capacity in Kozloduy NPP. Regarding point 2 of the same decision of the Ministry Council, the Minister of Economy, Energy and Tourism in entrusted to submit to the Ministry council a report regarding Art. 45, par. 2 of the Safe use of nuclear energy act with a view to be taken a decision on the merits and a report on the legal form for the implementation of the project.

On June 7, 2018 The National Assembly of the Republic of Bulgaria, on the basis of article 86, para. 1 of the constitution of Republic of Bulgaria, decided to resume the actions on the search for opportunities for the construction of the Belene NPP. In its decision, the National Assembly advised the Council of Ministers to take action to repeal its decision no 250 from 29 March 2012 in order to negotiate with potential investors and equipment manufacturers. This repeal became a fact with the adoption of the Ministry Council decision no447 from 29 June 2018. It should be noted that the adopted decision and the possible restart of the construction of the Belene NPP (by repealing the Ministry Council Decision no 250/29.03.2012) does not imply the cessation of the activity of Kozloduy NPP – New Builds Plc. These acts of the legislative and executive authorities relate only to the Belene NPP project, with no legal effect on the project for the construction of a new nuclear power plant on the site of Kozloduy NPP. The establishment of the company is in a result of a valid decision of the single owner of its capital (Kozloduy NPP PLC), which has received the preliminary agreement under the guidance of Bulgarian Energy Holding PLC, according to the establishment acts of the two companies. These actions were taken in pursuance of a decision of the Council of Ministries regarding paragraph 1 of Protocol No 14 from 11 April 2012, which gave an agreement in principle for the construction of a new nuclear power capacity of the latest generation at Kozloduy NPP site and which is not affected by the repeal of the Ministry council Decision no250/29 March 2012. ALso it should be taken into account the decision of the National Assembly from 2012, which is not repealed, and according to it he Minister of Economy, Energy and Tourism is entrusted with activities for the construction of anew nuclear power plant on the site of Kozloduy NPP.
