The five-member composition of VAS has ruled the legality of the EIA for the construction of new nuclear power on site 2 of Kozloduy NPP
The five-member Chamber of the Supreme Administrative Court dismissed the appeals against decision No 1-1/2015. Of the Minister of Environment and Water, which approved the environmental impact assessment in connection with the realization of an investment proposal "construction of a new nuclear power from the latest generation at the Kozloduy NPP site 2. This result was reached after the annulment of a decision of a three-member Chamber of 17 May M, which annulled the assessment. Decision on Adm. Case no 12369, 2018. is final.
The five-member group considered that in the issuance of decision No1-1/2015, the obligatory procedures of the EIA Ordinance were complied with, including Environmental impact assessment in a cross-border context.
As regards the question raised by the appellants as to the long-term solution to the problem of irradiated nuclear fuel and radioactive waste, the Court held that, by law, it was the duty of a third party neučastvaŝo in the administrative procedure. The management of spent nuclear fuel, radioactive waste and environmental measures related to this activity and the protection of human life and health is within the competence of state-owned enterprises "Radioactive waste" under The law and not the Kozloduy NPP – new capacities EAD, which is the contracting authority of the investment proposal for the construction of new nuclear power.
As regards the question of choice of site 2 posed by the appellants, the Cassation Court observes that the choice was made in accordance with the opinions of the team of specialised experts drawn up the EIA report, the specialised Departments, including those responsible for the conservation of biological diversity and for the protection of water resources, including and "water supply and sewerage" LTD., Town of Vratsa, which manages the water supply facilities in the area.
On the subject of groundwater monitoring, the Court considered that an explicit measure was envisaged as part of the already functioning monitoring system for Kozloduy NPP. The five-member Chamber also finds that the report has explicitly taken an opinion on the impact on the protected species of Alosa sp. and invasive species of Asian kortibula, with specific protection measures foreseen. This question was also put to the public consultation in the Republic of Romania, as well as the opinion of the National Office for Nature Protection.
